Brickshelter Real Estate Refund and Return Policy

At Brickshelter, we value our clients and strive to provide clear, transparent policies regarding property purchases. We understand that real estate transactions are significant investments, and there may be situations where refunds or cancellations are requested. This Refund and Return Policy outlines the terms and conditions under which refunds or cancellations may be considered.
1. Deposit Refund Policy
- Cooling-Off Period: If you make an initial deposit on a property, Brickshelter allows a [7-14 day] cooling-off period during which you may cancel the transaction and receive a full refund of your deposit, provided no legal agreements have been signed.
- Cancellation After Cooling-Off Period: If you cancel the transaction after the cooling-off period, a partial refund of the deposit may be granted, subject to administrative or legal fees. Refunds beyond this period will be assessed on a case-by-case basis, depending on the status of the transaction and any incurred costs.
2. Off-Plan Property Refunds (For Under-Construction Projects)
- Cancellation Before Completion: If you purchase an off-plan property (one that is under construction), you may request to cancel the purchase before the project is completed. In such cases, Brickshelter may issue a refund minus any applicable penalties, legal fees, or administrative costs associated with the cancellation.
- Project Delays or Non-Delivery: If Brickshelter fails to deliver the property within the agreed-upon timeframe or fails to meet contractual obligations, you may be eligible for a refund. In such instances, the terms of the refund will be discussed and documented based on the specific contract signed at the time of purchase.
3. Land Purchase Refunds
- Title or Legal Issues: In the event that Brickshelter is unable to provide valid legal documents (e.g., Certificate of Occupancy, Deed of Assignment, etc.) for a purchased plot of land, you are entitled to a full refund of the amount paid. This refund will only apply if the issue is due to Brickshelter’s inability to secure the necessary legal ownership documents.
- Environmental or Zoning Issues: If the purchased land is found to have significant environmental concerns, zoning restrictions, or other legal encumbrances that were not disclosed prior to purchase, a full or partial refund may be granted based on the situation and timing of the discovery.
4. Payment Plan Cancellations
- Cancellations During Payment Plans: If you are on a payment plan for a property and decide to cancel your purchase before completing the full payment, Brickshelter may offer a refund for the payments already made, minus any agreed-upon penalties or administrative fees. Refund eligibility and the amount refunded will depend on how much of the payment has been completed and how far along the transaction process is.
5. Non-Refundable Fees
The following fees are non-refundable in all cases:
- Administrative or processing fees incurred during the preparation of contracts and documentation.
- Legal fees associated with the property transaction, including title searches and due diligence.
- Any government fees or taxes that have been paid on your behalf during the course of the transaction.
6. Refund Process
- Refund Request: To request a refund, you must submit a written request detailing the reason for the cancellation or refund request, along with any supporting documentation.
- Review Period: Brickshelter will review your request within [15-30] business days and provide a response. If your request is approved, we will inform you of the terms and conditions of the refund, including any applicable deductions.
- Refund Timeframe: Once approved, refunds will be processed within [30] business days through the same payment method used for the original transaction, unless otherwise agreed upon.
7. Cancellation by Brickshelter
Brickshelter reserves the right to cancel any transaction under certain circumstances, including but not limited to:
- Inability to deliver the property due to legal or regulatory constraints.
- Fraudulent or misleading information provided by the buyer.
- Failure by the buyer to meet payment deadlines or other contractual obligations.
In such cases, Brickshelter will provide a full refund of all payments made, excluding any non-refundable fees or costs incurred due to the buyer’s actions.
